ADRENALIZING MEDIA US LLC – Terms & Conditions (Global / EU-compliant)
1. General Information & Scope
These Terms and Conditions (“Terms”) apply to all contracts between Adrenalizing Media US LLC, 5900 Balcones Dr Ste 100, Austin, TX 78731, USA (“Provider”) and its customers.
The Provider operates an online store via Squarespace, offering digital content (downloads, NFTs) and physical merchandise.
Delivery is worldwide except Russia and China.
2. Contract Formation
Product presentations in the online store do not constitute a legally binding offer but an invitation to purchase.
By clicking the “Buy” button, the customer makes a binding offer.
The contract is concluded when the Provider confirms the order or delivers the product/digital content.
Pre-Orders: Estimated delivery dates are provided; the Provider will notify customers of any delays. Customers may cancel pre-orders up to [x] days before shipping.
3. Prices, Taxes & Payment
All prices are in USD.
Shipping, import duties, and local taxes (e.g., VAT for EU customers) are the responsibility of the customer.
Digital products sold to EU customers will include VAT according to applicable laws.
Accepted payment methods: PayPal, Credit Card, Stripe.
Payments are processed via third-party providers; the Provider is not responsible for their availability or technical issues.
4. Delivery & Shipping
Digital Products (MP3, WAV, MP4, PDFs, JPEGs, NFTs) are available for immediate download/use after payment.
Physical Products (shirts, hoodies, caps, mugs, bundles, pre-orders) are shipped after payment. Delivery times depend on the destination.
Customers are responsible for shipping risks. Delays caused by postal, customs, or transport services are outside the Provider’s liability.
5. Cancellation & Returns

6. Warranty & Liability
Physical goods: Legal warranty applies (e.g., defective or incorrect items).
Digital content: No liability for compatibility with hardware/software, availability, or completeness.
Limitation of Liability: Provider is not liable for indirect, consequential, or lost profit damages, to the extent permitted by law.
Customers agree to indemnify the Provider against claims from third parties arising from unlawful use of products.
7. Intellectual Property & License
All content (music, videos, PDFs, JPEGs, NFTs, designs, logos) is protected by copyright and trademark law.
Customers are granted a non-transferable, personal license for private use only.
Redistribution, reproduction, public performance, or commercial use is prohibited.
7.1 Digital Music Download Terms of Use
License Grant
Upon purchase, you are granted a limited, non-exclusive, non-transferable license to download and use the purchased song file for private, personal, and non-commercial purposes only. This license is perpetual, provided you comply with these terms.
Ownership
All rights, title, and interest in and to the song, including but not limited to copyright, remain with the rights holders (artists, composers, labels, or licensors). No ownership rights are transferred to you by your purchase.
Permitted Use
You may:download the file to your own devices without time limit; make personal backups; play and enjoy the file privately.
Prohibited Uses
You may not: copy, redistribute, or share the file with others; resell, sublicense, or otherwise make the file available to third parties; publicly perform, broadcast, or stream the file; modify, remix, or create derivative works, unless explicitly authorized.
Duration of Access
Once downloaded, the file remains yours to use under these terms. We recommend that you create backups for your own security, as continued download availability through our platform cannot be guaranteed indefinitely.
Reservation of Rights
All rights not expressly granted herein are reserved by the rights holders. Any unauthorized use may constitute a violation of copyright law.
8. Data Protection / Privacy
Personal data is collected and processed only to fulfill orders.
Data may be shared with third parties only as necessary to fulfill the contract (e.g., payment processors, shipping services).

10. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Arizona, USA.
Jurisdiction for all disputes is Tucson, Arizona, USA.
Mandatory consumer protection rights in the customer’s country remain unaffected.
11. Changes to Terms
The Provider reserves the right to modify these Terms at any time.
Changes take effect upon publication on the website. Continued use of the website/shop constitutes acceptance of the updated Terms.
12. Final Provisions
If any provision of these Terms is invalid, the validity of the remaining provisions shall remain unaffected.
